1. Introduction

Welcome to Tomes, a product of Elanor Labs Inc. (“Elanor Labs”, “we”, “us”) — an AI co-pilot designed to assist dentists and dental practice managers with practice data analysis, insights, and operational support. By accessing or using Tomes, you agree to be bound by these Terms & Conditions.

Please note that Tomes is currently in private beta. Features, functionality, and availability are subject to change without notice.

2. Acceptance of Terms

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions. If you do not agree with any part of these terms, you must not use Tomes.

3. Eligibility

To use Tomes, you must be:

• A licensed dental professional (dentist, dental hygienist, or other authorized clinician), or
• An authorized member of dental practice staff with permission to access practice management data.

By using this service, you represent and warrant that you meet these eligibility requirements.

4. Use of the Service

Tomes provides AI-generated insights, recommendations, and operational support based on data you provide or integrate from your practice management system. These insights are intended to assist with business operations, scheduling, revenue cycle management, and patient engagement.

Tomes is NOT a substitute for professional clinical judgment, diagnosis, or treatment decisions. All clinical decisions must be made by qualified, licensed healthcare professionals.

5. Beta Disclaimer

Tomes is currently offered as a private beta product. As such:

• The product may contain bugs, errors, or incomplete features.
• Data accuracy and system availability are not guaranteed during the beta period.
• Features may be modified, added, or removed at any time without prior notice.
• We reserve the right to reset, modify, or delete user data as needed for development purposes.

By participating in the beta, you acknowledge these limitations and agree to provide feedback to help improve the product.

6. User Responsibilities

As a user of Tomes, you agree to:

• Provide accurate and truthful information when using the service.
• Maintain the security and confidentiality of your account credentials.
• Ensure compliance with all applicable laws, including HIPAA (Health Insurance Portability and Accountability Act) when entering, storing, or transmitting any protected health information (PHI).
• Use the service only for lawful purposes and in accordance with these Terms.
• Not attempt to reverse engineer, decompile, or extract source code from the platform.

7. Intellectual Property

All software, content, branding, logos, trademarks, and materials provided through Tomes are the exclusive property of Elanor Labs Inc. and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you create derivative works based on our platform.

8. Privacy & Security

Your privacy is important to us. Our collection, use, and protection of your personal information and practice data are governed by our separate Privacy Policy, which can be found here.

Tomes is designed with HIPAA-conscious workflows. However, you are ultimately responsible for ensuring your use of the platform complies with all applicable privacy and security regulations.

9. Limitation of Liability

To the fullest extent permitted by law, Elanor Labs Inc. and its affiliates, officers, employees, and agents shall not be liable for:

• Any clinical or financial decisions made based solely on AI-generated output.
• Any direct, indirect, incidental, consequential, or punitive damages arising from your use of the service.
• Loss of data, revenue, profits, or business opportunities.
• Interruptions, errors, or security breaches during the beta period.

You acknowledge that Tomes provides informational support only and that all final decisions remain your sole responsibility.

10. Termination

During the private beta period, we reserve the right to suspend or terminate your access to Tomes at any time, with or without notice, for any reason including but not limited to:

• Violation of these Terms & Conditions.
• Suspected fraudulent or unlawful activity.
• Changes to the beta program or product roadmap.

You may also discontinue your use of Tomes at any time by contacting our support team.
